The Land and Environment Court has handed down a decision on a proposed development for 44 Manning Street, Kiama.

Council received an application to develop the site in May 2017, which would have seen the demolition of the existing building and construction of a three-storey mixed use development consisting of a ground floor commercial/retail space, 16 shop top dwellings and car park.
“Council requested additional information as the proposal did not comply with planning controls,” general manager Michael Forsyth said.
“Amended plans were received in August which still did not comply and council formally refused the application at a meeting on August 15.”
Following mediation hearings in October, further amended plans were submitted, which attempted to address the issues raised by council and the community.
“The Land and Environment Court have subsequently approved the amended plans,” Mr Forsyth said.
Two conditions will need to be met before consent becomes operational and the applicant has five years to start physical work on the site.
