The 26-year-old from North Wollongong was charged with stalking and intimidation after threatening to stab his alleged attacker “in an artery so that he bleeds to death within four minutes”.
Police documents say the accused alleges the man raped him in 2012 while they were both in the navy, a claim which is under investigation by NSW Police.
He claims he contracted HIV after the alleged rape and the police facts tendered in court state he discovered the whereabouts of his alleged attacker via Facebook.
The documents say that, on June 30, Bourne was at University House when he came to the attention of police, by repeatedly threatening to kill his alleged attacker.
He was taken to Wollongong Hospital’s mental health unit and was discharged the following day.
At the same time staff were concerned about the alleged threats the man was making and contacted police.
When police arrived he allegedly “bluntly reiterated his intention to purchase a knife and kill” the other man.
He was arrested by police and an apprehended personal violence order taken out to protect the subject of his alleged threats.
“I think it’s a good idea for you to do the AVO,” the man allegedly told police, “I don’t want you to lose your job when I kill him.”
Police Sergeant Wendy Nolan said there were concerns about bail being granted given “the threats that were made in the presence of police”.
The man’s lawyer Laura Fennell said he suffered post traumatic stress disorder since the alleged rape and had been without his medication for several days before making the threats.
“When the threats were made, he was not well, he was very unwell,” she said.
Registrar Kathy Frost granted the man bail under strict conditions, including that he not approach his alleged victim.
He will appear in Wollongong Local Court on July 5.
