Gerringong Surf School operator Rusty Moran says he has "acquiesced" to Kiama Municipal Council's licensing requirements for the summer period, which exclude the use of his preferred section of the beach..
"I have acquiesced and signed council's license to operate down the beach over summer," he said.
"Last week lawyers on both sides agreed on elements [of the license]
"I hope people who are concerned can see I've made an effort to acquiesce over summer."
However, the council says the license has not been finalised.
"The licence for Gerringong Surf School to operate at Seven Mile Beach is not finalised," a council spokesperson said.
"Council is currently considering amendments to the licence."
