Michael Peter Coghlan was sentenced to two months’ jail from December 5 by Magistrate Gabriel Fleming in Nowra Local Court on Monday.
Court documents stated Coghlan was living at a property at Bomaderry in July last year when an argument broke out with then homeowner over his “laziness and lack of motivation to get a job”.
Police allege Coghlan lost his temper, kicked over furniture, pulled a picture frame from the wall and yelled abuse towards the homeowner, allegedly saying “you think too much of the dog”.
During the frenzy he also allegedly kicked the 12-year-old Maltese terrier called Murphy in the stomach, lifting the dog off the ground.
The dog allegedly flew between two and three metres through the air, landing in a bedroom. Coghlan chased the dog and slapped it several times.
When confronted by police with this evidence he maintained he didn’t kick the dog he just “pushed it with my foot”.
He was sentenced to two months’ jail from December 5 until February 4.
Coghlan appealed the sentence but was was refused bail.
The appeal is listed for Nowra District Court on January 30.
