Council had received complaints by other pharmacies in the area that Good Price Pharmacy, located on the Princes Highway at Albion Park Rail, had been selling large quantities of goods that were outside its authorised use as a “bulky goods retail building”.
The matter has been taken to the NSW Land and Environment Court for allegedly breaching the Environmental Planning and Assessment Act.
The business operates under Altz Pty Ltd.
In 2011, Altz allegedly began using a part of the premises, which was formerly leased to a furniture retailer, as a shop to stock and display less bulky items, which is not permitted in the zone.
In May an adjournment was handed down to Altz, so they could seek a DA that permitted the premise to run as a neighbourhood shop.
