THE developers of Kiama Blue have dropped an appeal against the council's rejection of its application to build units in the heritage school building.
Nick Colys said he believed the council had rejected the original development application because of a technical error.
He said that when his brother, Mark, lodged the original DA for the work with the council the wrong name was put on as the applicant.
"Council didn't want to acknowledge the application because the name was incorrect, so now we've lodged a new application with the right name," he said.
"For the sake of peace, we just decided to accept it and moved on."
Colys Investments Pty Ltd lodged a notice of discontinuance with the Land and Environment Court.
A council spokeswoman said there were now no matters in court regarding Kiama Blue.
Mr Colys said the new DA to construct three units within the upper level of the old school heritage building at the site was the same as the previous one except for a different applicant name.
A council spokeswoman confirmed the application had been lodged under a different name, but said it was being assessed as a new application and had not been compared with the previous one.
